Constitutional Court Sets Aside Supreme Court Ruling on Monal Restaurant Demolition

 

Islamabad: The Federal Constitutional Court has set aside the Supreme Court’s ruling related to the demolition of Monal Restaurant in Pir Sohawa. It directed the trial courts to decide the ownership dispute independently and without being influenced by earlier judicial observations.

The Federal Constitutional Court accepted the appeals of CDA and Metropolitan City, the court also lifted the stay order, and directed the trial courts to decide the cases as soon as possible.

The Federal Constitutional Court ruled that the trial courts will decide the ownership without being influenced by judicial observations, and the regulatory bodies will decide administrative matters.

Justice Hassan Rizvi said that many points were not taken into account in the Supreme Court’s decision, the court got angry even when a case was filed or a review was filed, something was written in the decision that was not mentioned in the legend, we will not make an emotional decision.

Lawyer Ahsan Bhawan said that the court has read the case very well, to which Justice Hassan Azhar Rizvi said that do not praise us in court, they will give the same order as the hearing, they will not write Alif Laila’s story in the decision.

Justice Hassan Rizvi stated that after reading the decision, it was understood that a lot was written outside the court proceedings.
